These Terms and Conditions (“Terms”) govern the use of the website KSoul Travel and the purchase or booking of services and digital products offered through the website or directly by KSoul Travel.
By purchasing or booking a service or digital product, the Customer confirms that they have read and accepted these Terms.

For questions concerning purchases, services, cancellations or these Terms, Customers may contact KSoul Travel at the email address above.
KSoul Travel provides travel-related consulting, planning and organizational services, including:
Unless expressly stated otherwise, KSoul Travel does not act as the provider of third-party services such as flights, accommodation, transportation, insurance, restaurants, attractions or activities.
Where Customers book or purchase such services directly from third-party providers, the relevant contract is between the Customer and the third-party provider.
All KSoul Travel services and digital products are intended exclusively for persons aged 18 or over.
By purchasing a service or product, the Customer confirms that they are at least 18 years old.
All prices displayed or communicated by KSoul Travel are expressed in euros (€) and include applicable taxes where required, unless expressly stated otherwise.
The total price payable for a service will be communicated before the Customer becomes contractually bound.
Any services or costs not expressly included in the KSoul Travel price remain the Customer’s responsibility.
Depending on the service, payments may be made through Stripe, PayPal, Apple Pay, bank transfer, payment links or other payment methods expressly communicated by KSoul Travel.
Payment must be completed according to the instructions provided for the relevant service.
Where a service is offered through a personalized quotation, the quotation and payment instructions may be provided by email.
Customers may complete the Design My Trip questionnaire to provide KSoul Travel with information regarding their travel preferences, destination, travel style, requirements and other relevant information.
The questionnaire is intended to allow KSoul Travel to review the Customer’s request and prepare an initial personalized travel proposal.
The Design My Trip questionnaire service costs €18.99.
The fee covers the review and assessment of the Customer’s questionnaire and the preparation of an initial personalized travel proposal.
KSoul Travel will normally provide the initial proposal within 2 business days (approximately 48 business hours) after receiving the completed questionnaire and payment.
If the Customer subsequently purchases the personalized travel planning service proposed by KSoul Travel, the €18.99 questionnaire fee will be deducted from the final price of that service.
If the Customer decides not to proceed with the personalized travel planning service, the €18.99 remains the fee for the questionnaire review and initial proposal service already provided, subject to the Customer’s mandatory rights under applicable consumer law.
Where the Customer qualifies as a consumer and concludes a distance contract with KSoul Travel, the Customer generally has the right to withdraw from a service contract within 14 days from the conclusion of the contract, without having to provide a reason, subject to the exceptions and conditions established by applicable law.
Where the Customer wishes KSoul Travel to begin providing the service before the end of the 14-day withdrawal period, KSoul Travel may require the Customer to make an express request for the service to begin immediately.
The Customer may therefore be asked to confirm:
“I expressly request KSoul Travel to begin providing the service before the end of the 14-day withdrawal period and acknowledge that, once the service has been fully performed, I will lose my right of withdrawal.”
Where the Customer validly requests immediate performance and subsequently exercises the right of withdrawal before the service has been fully performed, the Customer may be required, where permitted by applicable law, to pay an amount proportionate to the service already provided.
Once the service has been completely performed, the Customer loses the right of withdrawal where the conditions required by applicable consumer law have been satisfied, including the Customer’s prior express consent/request and acknowledgement of the loss of the right following complete performance.
Nothing in these Terms limits any mandatory consumer right that cannot legally be excluded.
After reviewing the questionnaire, KSoul Travel may send the Customer a personalized proposal by email.
The proposal may include:
If the Customer accepts the proposal, full payment of the agreed travel planning fee is required before KSoul Travel begins preparing the personalized itinerary, unless otherwise expressly agreed.
The €18.99 questionnaire fee will be deducted from the agreed final price.
Payment may be made through bank transfer, Stripe, PayPal, payment link or another method communicated by KSoul Travel.
The applicable Terms and the information necessary for the Customer to make an informed purchase decision will be made available before payment.
Where the Customer wishes KSoul Travel to begin working on a personalized itinerary before the expiry of the applicable 14-day withdrawal period, KSoul Travel may request express confirmation by email or through another appropriate electronic mechanism.
For example, the Customer may be asked to reply:
“I expressly request KSoul Travel to begin providing the service before the end of the 14-day withdrawal period and acknowledge that, once the service has been fully performed, I will lose my right of withdrawal.”
KSoul Travel may wait to begin work until the required payment and, where applicable, the Customer’s request for immediate performance have been received.
Unless otherwise agreed, personalized itineraries require a minimum of 5 business days to prepare.

Where available, KSoul Travel may offer an urgent service with delivery within approximately 48 hours.
Urgent requests are accepted at KSoul Travel’s discretion and may be subject to an additional fee. Any additional fee will be communicated and agreed before payment.Depending on the complexity of the trip, destination, duration and Customer requirements, preparation may require up to 30 days.

One complimentary revision of the personalized itinerary is included, provided that the Customer requests the revision within 3 days of delivery.
Additional revisions or substantial changes may be subject to an additional fee.
Any additional fee will be communicated to and agreed with the Customer before the additional work begins.
Except where a mandatory right of withdrawal or another mandatory consumer right applies, a Customer is not entitled to a refund merely because:
This provision does not exclude or restrict statutory rights relating to non-performance, defective performance or other rights that cannot legally be waived.
Unless expressly agreed otherwise, Customers remain responsible for booking and paying third-party travel services directly.

Where no advance payment is required, KSoul Travel may, where agreed, assist with or make simple reservations such as restaurant or museum reservations on behalf of the Customer.
KSoul Travel does not control the terms, availability, prices, cancellations, service quality or actions of independent third-party providers.KSoul Travel may research, recommend or provide links to hotels, flights, transportation,
KSoul Travel may sell pre-prepared digital travel guides in PDF or other digital formats.
Digital guides are supplied electronically and are generally made available for download immediately after successful payment.
Because digital guides constitute digital content supplied without a tangible medium, Customers requesting immediate access may be required to provide their prior express consent to immediate supply and acknowledge the resulting consequences for their right of withdrawal under applicable law.
Before obtaining immediate access, the Customer may therefore be required to confirm:
“I expressly consent to the immediate supply of the digital content and acknowledge that, once the supply begins, I will lose my right of withdrawal.”
Where all requirements imposed by applicable consumer law have been satisfied, the Customer loses the applicable right of withdrawal once the supply of the digital content begins.
If the legally required consent or acknowledgement has not been properly obtained, the Customer retains any rights granted by applicable law.
If a Customer successfully completes payment but is unable to access or download the purchased guide because of a technical problem, the Customer should contact:

After verifying the purchase, KSoul Travel will normally send or otherwise provide access to the purchased digital guide within 24 hours.
A technical download issue does not cancel the Customer’s purchase where KSoul Travel is able to provide the purchased content through an alternative reasonable method.
Digital travel guides are provided exclusively for the Customer’s personal and non-transferable use.
Customers may not, without prior written authorization from KSoul Travel:
Unauthorized distribution or commercial exploitation may constitute an infringement of KSoul Travel’s intellectual property rights.
Travel information can change rapidly.
Prices, opening hours, schedules, availability, restaurants, hotels, transportation, attractions, entry requirements, visa rules and other information contained in a guide may change after publication.
KSoul Travel aims to provide useful and accurate information at the time of preparation but does not guarantee that every piece of information will remain current indefinitely.
Customers should verify important and time-sensitive information, particularly immigration, visa, health, safety and entry requirements, through the appropriate official sources before travelling.
KSoul Travel may offer paid travel consultations or video calls booked through Calendly or another booking platform.
The price, duration, availability and specific cancellation or rescheduling conditions applicable to a consultation will be displayed or communicated during the booking process.
Any specific booking conditions presented and accepted when booking the call supplement these Terms.
Mandatory consumer rights remain unaffected.
Travel With Me offers selected group travel experiences organized and accompanied by KSoul Travel.
Unless expressly stated otherwise in the specific trip offer, the amount charged by KSoul Travel relates to KSoul Travel’s own services, which may include:
Unless expressly stated otherwise under a legally appropriate arrangement, third-party travel services such as flights, accommodation, transport, insurance and paid activities are not sold by KSoul Travel as part of the KSoul Travel service fee and are booked and paid separately.
The exact services included and excluded will be stated on the relevant trip page or booking information.
Each Travel With Me trip will have its own trip information specifying, where applicable:
The information relating to the specific trip forms part of the agreement with the participant.
Unless otherwise stated for a particular trip, a participant may reserve a place by paying a deposit equal to 30% of the total KSoul Travel service fee.
The remaining 70% balance must be paid by the deadline communicated on the trip page, booking confirmation or other written communication.
Failure to pay the balance by the applicable deadline may result in cancellation of the reservation, subject to applicable law and the conditions communicated for the relevant trip
If a participant voluntarily cancels their participation in a Travel With Me trip, the following commercial cancellation policy applies to refundable amounts paid to KSoul Travel, subject always to any mandatory rights provided by applicable law:
90 days or more before departure:
100% refund.
Between 89 and 31 days before departure:
50% refund.
30 days or less before departure:
No refund.
The calculation is based on the amounts actually paid to KSoul Travel.
This cancellation policy does not exclude any statutory right that cannot legally be waived or restricted.
A Travel With Me trip may require a minimum number of participants.
The applicable minimum will be specified on the relevant trip page or booking information.
If the minimum number is not reached, KSoul Travel may cancel the trip.
Where cancellation is due to failure to reach the required minimum, KSoul Travel will normally notify participants at least 45 days before departure, unless a different period is required by applicable law or clearly stated for the specific trip.
If KSoul Travel cancels a Travel With Me trip, amounts paid directly to KSoul Travel for the cancelled KSoul Travel service will be refunded in full, subject to applicable law.
Unless KSoul Travel is legally responsible for such costs, KSoul Travel will not reimburse independently purchased services such as flights, accommodation, insurance, visas, transportation or other third-party bookings.
For this reason, participants are strongly encouraged to use flexible/refundable bookings where appropriate and obtain suitable travel insurance.
Where a refund is legally due following the valid exercise of a statutory right of withdrawal, KSoul Travel will process the refund without undue delay and within the period required by applicable law, generally no later than 14 days from the date on which KSoul Travel is informed of the valid withdrawal.
Unless otherwise agreed where legally permitted, the refund will generally be made using the same payment method used for the original transaction.
Different processing rules may apply to contractual refunds granted under a specific Travel With Me cancellation policy where no statutory withdrawal is involved, but KSoul Travel will process such refunds within a reasonable period and in accordance with applicable law.
Travel inherently involves circumstances that may require changes.
KSoul Travel may make reasonable changes to an itinerary, schedule, meeting point, activity or other organizational element where necessary because of circumstances including:
Where reasonably possible, KSoul Travel will seek to preserve the overall nature and quality of the planned experience.
Each Travel With Me trip may be assigned a Physical Level or contain information about the expected physical demands.
Participants are responsible for assessing whether they are physically capable of participating safely.
Where uncertain, participants should obtain appropriate medical advice before booking or travelling.
Participants should inform KSoul Travel before departure of relevant requirements that may materially affect their ability to participate safely in planned activities, where appropriate.
Participants are responsible for ensuring that they possess valid passports, visas, permits and other documents required to enter, transit through and remain in the relevant destination.
KSoul Travel may provide general information or assistance regarding entry requirements but does not provide immigration or legal advice and cannot guarantee:
Participants must verify current requirements through official government, embassy or consular sources.
Travel insurance is strongly recommended for Travel With Me participants.
For certain trips, destinations or activities, travel insurance may be mandatory.
Any specific insurance requirement will be communicated before departure or booking where appropriate.
Participants remain responsible for ensuring that their insurance coverage is suitable for their circumstances and planned activities.
Participants must behave in a manner that does not endanger themselves, other participants, KSoul Travel personnel, third parties or the operation of the trip.
KSoul Travel may, in serious circumstances and to the extent permitted by law, terminate a participant’s participation where their behaviour includes:
Termination for serious misconduct does not automatically entitle the participant to a refund.
Where legally permissible, additional accommodation, transportation or return travel costs arising from the participant’s removal may remain the participant’s responsibility.
Some Travel With Me experiences may be offered as Women’s Only, while others may be offered as Mixed Group trips.
The applicable format will be clearly indicated on the relevant trip page before booking.
All participants must be at least 18 years old.
KSoul Travel is connected with travel and digital content creation activities.
During Travel With Me experiences, photographs, videos and other content may be created for purposes including documenting the trip and communicating or promoting KSoul Travel through its website, social media channels or other communications.
Where an identifiable participant’s consent is legally required for a particular use, KSoul Travel will seek the appropriate consent.
Participants who have specific concerns or do not wish to appear in promotional content should inform KSoul Travel before departure so that reasonable arrangements can be discussed.
Participation in a Travel With Me trip does not by itself constitute unlimited consent to the commercial use of a participant’s image where separate consent is required by applicable law.
Customers are responsible for providing accurate, complete and current information where that information is necessary for KSoul Travel to provide the requested service.
KSoul Travel is not responsible for problems caused by materially incorrect or incomplete information provided by the Customer.
Third-party providers operate independently from KSoul Travel unless expressly stated otherwise.
Where a Customer contracts directly with a third-party provider, that provider’s own terms, cancellation conditions and policies apply.
Any dispute concerning a third-party service should generally be addressed to the relevant provider, without prejudice to any liability that KSoul Travel may have under mandatory applicable law.
Travel involves personal decisions and risks.
Customers remain responsible for evaluating destinations, activities, transportation, accommodation and other travel choices according to their own circumstances.
KSoul Travel recommendations are based on information available at the relevant time and do not constitute guarantees of individual experience, safety, availability or suitability.
Unless otherwise stated, the original content created by KSoul Travel, including itineraries, guides, written materials, graphics, photographs, videos, branding and original website content, is owned by or licensed to KSoul Travel and is protected by applicable intellectual property laws.
Purchase of a service or digital product does not transfer intellectual property ownership to the Customer.
Content may not be reproduced, commercially exploited, resold or redistributed without authorization, except where permitted by law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to mandatory law, KSoul Travel is not responsible for events outside its reasonable control or for acts or omissions of independent third-party providers with whom the Customer contracts directly.
KSoul Travel does not guarantee that travel will be free from delays, cancellations, closures, weather events, governmental restrictions, strikes or other circumstances outside its reasonable control.
KSoul Travel will not be responsible for failure or delay in performing an obligation where such failure or delay results from circumstances beyond its reasonable control, to the extent permitted by applicable law.
Such circumstances may include natural disasters, extreme weather, epidemics, pandemics, war, civil unrest, governmental measures, strikes, transportation disruption or other extraordinary events.
Mandatory consumer rights remain unaffected.
Personal data is processed in accordance with the KSoul Travel Privacy Policy and applicable data-protection legislation.
The Privacy Policy is separate from these Terms and is available through the KSoul Travel website.
Where separate consent is legally required for a particular processing activity, such as certain marketing communications, KSoul Travel will request that consent separately.
The use of cookies and similar technologies is described in the KSoul Travel Cookie Policy.
Where legally required, non-essential tracking technologies will only be activated after the user has provided the appropriate consent.
Users will be provided with the ability to manage their cookie preferences as required by applicable law. Italian Garante guidance distinguishes necessary/technical cookies from profiling and other non-essential tracking technologies and requires consent for the latter.
Contracts and purchases may be concluded electronically, including through the KSoul Travel website, email, payment links or third-party booking/payment platforms.
KSoul Travel may provide order confirmations, contractual information and other relevant communications electronically, including by email.
Customers are responsible for providing a valid email address and for checking communications relating to their purchase.
KSoul Travel may update these Terms from time to time.
The version applicable to a purchase or booking will generally be the version made available to the Customer at the time the relevant contract is concluded.
Changes made after a contract has been concluded will not retroactively alter the Customer’s contractual rights unless agreed or required by applicable law.
These Terms are governed by Italian law.
Where the Customer qualifies as a consumer residing in another country, this choice of law does not deprive the Customer of mandatory consumer protections applicable to them under relevant law.
Nothing in these Terms limits mandatory jurisdictional rights available to consumers.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
